GENERAL TERMS

Welcome to the VISITLATVIA.LV, HOTELS.LV, VIESNICAS.LV portal (hereinafter in the text referred to as the PORTAL). The owner and maintainer of the PORTAL is a company registered in Latvia, "Travel Baltic Latvia" LTD.
The PORTAL has been created to help travellers get information about Latvia and let them get a larger view of the services provided by companies operating in the tourism business in Latvia. The PORTAL offers the possibility to book/request hotel rooms and conference halls under the terms for booking hotel rooms and booking conference halls that are specified below.

Please carefully read the terms of use of the PORTAL! The terms of use of the PORTAL are binding for all users of the PORTAL regardless of whether he or she is or is not a registered user of the PORTAL.

• If you visit the PORTAL, you agree with the present terms and undertake to observe them.
• If you do not agree with the present terms, do not visit the PORTAL.

THE OWNER AND MAINTAINER of the PORTAL retains the right to amend the present terms without prior notice, and the amendments shall come into force from the moment when they are published on the PORTAL, and your visit to the PORTAL shall attest that you agree with the present terms.

LIMITATION OF RESPONSIBILITY

1. The owner and maintainer of the PORTAL shall not be held liable for any losses:
   • that may be caused by a virus during a visit or download from the PORTAL;
   • that have appeared when using the information available on the PORTAL;
   • that have appeared as a result of failure to timely cancel booking of a hotel room/conference hall.
2. The owner and maintainer of the PORTAL shall neither be held liable for:
   • accessibility of the PORTAL;
   • any technical problems in work of the PORTAL;
   • messages sent by users of the PORTAL (both registered and not registered) using the available options "send a letter to a friend" or "add a comment";
   • change in data of registered users of the PORTAL as a result of unauthorized access of another person.
3. The work of the PORTAL (including the available services) is offered as is, without any additional guarantees on the part of the owner and maintainer of the PORTAL.
4. The owner and maintainer of the PORTAL shall, to the extent possible, ensure work and functionality of the PORTAL 24 hours a day, 7 days a week, however, not guaranteeing that the PORTAL will function without breakdowns in the system.
5. The owner and maintainer of the PORTAL does not control or service Internet links to other home pages that are found on the PORTAL, and consequently shall not be liable for the information published on these pages.
6. The special offers are offered to the PORTAL by our partners. If such offers have limitations and terms, they are listed next to each of the offers.
7. The owner and maintainer of the PORTAL shall do everything that is possible to ensure that information published at the PORTAL is true, precise and actual, but however does not guarantee that errors and distortions of information will not appear in the published information due to unforeseen conditions.

RESPONSIBILITY OF VISITORS OF THE PORTAL

1. It is forbidden for users of the PORTAL to damage deliberately and hinder work of the PORTAL.
2. It is forbidden to place links from other home pages to the home page of www.visitlatvia, www.hotels.lv and www.viesnicas.lv without prior agreement.
3. It is forbidden to place comments or send information to other users of the PORTAL or potential users of the PORTAL:
   • If intellectual property rights (copyrights, etc.) of the third parties are violated as a result of it being placed or sent;
   • if it offends dignity and respect of another person;
   • if it provokes violence, racial intolerance or carrying out of other illegal activities;
   • if it is vulgar, libelous or insulting in another way;
   • if it contains computer viruses or has been created to harm functionality (security) of a computer or electronic connection software;
   • if it has features of spam (junk mail, spam, chain letter) or unauthorized advertising;
   • if it is pornographic or excessively erotic;
   • information of any other kind that affects or might affect normal work and security of the PORTAL. Having discovered that such information is placed on the PORTAL, the owner and maintainer thereof shall have the right to immediately delete it.
4. When booking using the PORTAL:
   • users of the PORTAL shall only make a founded registration or booking, fake bookings are STRICTLY prohibited. Should it be discovered that fake data has been specified, the owner and maintainer of the PORTAL shall be entitled to immediately delete it and profiles of the person who has created them, without prior notice;
   • the owner and maintainer of the PORTAL shall not be held liable for imprecise booking;
   • before confirming a booking, please check the description of hotel/conference hall and the terms for cancellation of the booking, in order to verify the services included in the price of the hotel room/conference hall that is specified on the PORTAL;
   • confirmation of a booking means that you agree with all of the specified terms related to execution of your request;
   • when a booking has been confirmed, it is possible to cancel the booking within the time period specified in the terms;
   • booking of conference halls and the requested services shall be deemed complete and the services specified in the request shall be guaranteed only upon fulfilment of financial obligations;
   • if you cancel a booking after the time period specified in the terms of a hotel/conference hall or fail to arrive at all, a penalty fee may be debited from your account, as specified in the booking terms of a hotel/conference hall.

REGISTERED USERS

When you become a registered user of the PORTAL, you shall be fully responsible for information specified in your user profile, as well as for any use of your profile, also in cases when it is used by another person.

COPYRIGHT AND LICENSES

1. "Travel Baltic Latvia" LTD owns the PORTAL and all intellectual property rights related thereto.
2. It is forbidden to perform the following actions with the information found on the PORTAL:
   • copy;
   • emulate;
   • re-publish;
   • upload or distribute;
   • change data, information or materials;
   • use it for commercial purposes;
   • translate it into any other language.
3. It is only allowed to copy or upload the information found in the "user notes" of registered users, including information on hotel room/conference hall booking and information attached to the user notes. However, it is forbidden to use the said information for commercial purposes, as well as emulate, re-publish or distribute it, or distort data without written consent of the owner and maintainer of the PORTAL.
4. In case of violation of copyright, the person at fault shall be fully responsible for the losses inflicted upon the PORTAL as a result of such actions, and shall be called to the criminal responsibility stipulated by the law. 

SECURITY AND CONFIDENTIALITY OF THE SPECIFIED DATA

All information, that you provide when making a booking or becoming a registered user, is confidential and will not be disclosed to the third parties.

 
SETTLEMENT OF DISPUTES

1. All disputes that appear between the owner of the PORTAL, maintainer of the PORTAL and users of the PORTAL with regard to the present terms, shall be settled through mutual negotiations.
2. Should it not be possible to settle disputes and disagreements through mutual negotiations, then, since "Travel Baltic Latvia" LTD, the owner and maintainer of the PORTAL, is a company registered in Latvia, and activity thereof is governed by the law of the Republic of Latvia, they shall be settled under the law of the Republic of Latvia.
